When the Glan Devon application restarts

There may be a large amount of new material: consultant reports, revised models, updated plans, responses to questions and new technical appendices.

The first thing to remember is simple:

More pages do not necessarily mean more evidence.

A 200-page report may contain only one genuinely new fact. A short revised drawing may completely change part of the proposal.

So rather than trying to read everything at once, start with a different question:

What has actually changed?

Most new information falls into a few basic categories.

  • New assertion — the applicant or consultant says something new, but provides no new evidence.

  • New explanation — more detail is provided about an existing claim.

  • New data — there are genuinely new measurements, tests, samples or monitoring results.

  • New analysis of old data — the evidence is the same, but somebody has analysed or interpreted it differently.

  • New model using old data — the modelling has changed, but the underlying evidence has not.

  • New model using new data — both the evidence and the modelling have changed.

  • Changed assumption — an input or assumption used in an assessment has been altered.

  • Changed design — the plant, process, layout or equipment has actually changed.

  • Changed operating envelope — limits on things such as throughput, feed composition, temperature, operating hours or emissions have changed.

  • Changed assessment — a consultant now reaches a different conclusion.

  • Changed approval request — the applicant is now asking Council or the State to approve something different.

  • New condition or commitment — something is promised, monitored or deferred until later.

These are not equivalent.

A new assertion is not the same as new data. A new model is not necessarily new evidence. A different conclusion does not automatically mean the underlying problem has been resolved.

Use five questions

For any important issue, ask:

  1. What did the application say before?

  2. What does it say now?

  3. What actually changed underneath it — data, assumptions, design, modelling, judgement, or nothing?

  4. Does that change resolve the original concern?

  5. Does the change create another question somewhere else?

That last question matters.

For example, the applicant might respond to uncertainty about a feed material by placing tighter limits on what can be used. That may genuinely improve the proposal.

But it immediately raises another question:

How will those limits be checked and enforced, and what happens when material falls outside them?

Likewise, a much larger air-quality report might appear. Before being impressed by its size, ask whether there is any new emissions testing underneath it. If the same limited test data are simply being run through a more elaborate model, the modelling may be new while the underlying evidence problem remains.

Watch for the common traps

One of the easiest traps is volume masquerading as evidence. Long reports can make a response look substantial even where very little has changed.

Another is new modelling using the same inputs. A more complicated model cannot create measurements that do not exist.

Watch also for assumptions quietly becoming facts. Words such as will, expected, anticipated, typically and designed tomay describe intentions or assumptions rather than demonstrated performance.

And be careful when an issue is simply moved into a future condition:

“This will be determined before operation.”

That may be a reasonable management measure, but it is not necessarily evidence that the question has been answered now.

Finally, if one part of the proposal changes, check what else depends upon it. A changed process flow, feed rate, water balance, stack parameter or traffic assumption may require several other assessments to change as well.

Do not try to read everything at once

You do not need to become an air-quality modeller, process engineer or planning lawyer to make a useful submission.

Start with the issues you already understand.

Find the old position.

Find the new position.

Identify the difference.

Then ask whether the difference is new evidence, a real change to the proposal, or simply a new way of describing the same thing.

That is often the fastest way to see through hundreds of pages of technical material.

The important question is not “How much new information is there?”

It is:

“What changed, and does that change actually resolve the problem?”
